Benefits Check Has Been Reduced in Savannah

I haven’t returned to work but my weekly benefits check has been reduced. Can they do that?

It depends on several variables, including your work status. If your doctor has changed your work status from “no work” to “light duty” work and your employer has offered you a position in compliance with the light duty restrictions—but at a lesser wage—the employer can reduce your benefits to two-thirds the difference in your previous wage and your current wage.

On the other hand, if you have been released to light duty work and are not currently working, your employer can reduce your benefits; however, not until one year from the date of your physician’s light duty release.
